Terms of service
Last updated: October 10, 2026
OVERVIEW
Welcome to OverThinking Concept.
These Terms of Service govern your access to and use of the OverThinking Concept online store and website, including the purchase of products offered through the store.
Throughout these Terms, the terms “we,” “us,” “our,” and “OverThinking Concept” refer to the individual operating the OverThinking Concept store under that trade name.
By accessing our website, browsing our store, creating an account, or purchasing products from us, you agree to these Terms and any policies referenced in them, subject to applicable law.
If you do not agree with these Terms, please do not use our website or purchase products from our store.
Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products and services.
1. ACCESS TO THE WEBSITE
You may use our website for lawful purposes and in accordance with these Terms.
You must not use the website in a way that violates applicable laws or regulations, infringes the rights of others, interferes with the operation or security of the website, or attempts to gain unauthorized access to systems or data.
We reserve the right to restrict or terminate access where reasonably necessary to protect the website, our customers, our business, or third parties, subject to applicable law.
2. OUR PRODUCTS
We make reasonable efforts to provide accurate descriptions, images, specifications, and prices for our products.
Colors and visual appearance may vary depending on your device, screen settings, lighting, and other factors. Product images may be illustrative, and minor variations may occur during manufacturing.
Some products are made to order or fulfilled by third-party manufacturing and fulfillment partners.
Product availability may change. We reserve the right to discontinue products or modify product specifications when reasonably necessary, without affecting orders already accepted unless otherwise permitted by law.
3. PRODUCT AVAILABILITY AND MADE-TO-ORDER PRODUCTS
Certain products offered through OverThinking Concept may be manufactured after an order is placed.
Because of this production model, cancellations, returns, or exchanges for reasons such as a change of mind, incorrect size, or incorrect color may be limited where applicable law permits.
Made-to-order status does not automatically remove any statutory cancellation or withdrawal right. Any exception applies only where the relevant legal requirements are met.
Nothing in these Terms limits mandatory consumer rights relating to defective, damaged, incorrect, or non-conforming products.
Additional information is provided in our Return and Refund Policy.
4. ORDERS
Placing an order through our website constitutes an offer to purchase the selected products.
After you submit an order, we will send an electronic confirmation acknowledging receipt of your order. This confirmation does not necessarily mean that the order has been finally accepted.
An order may be refused or cancelled for reasonable reasons, including product unavailability, an obvious pricing or technical error, unsuccessful payment authorization, or reasonable suspicion of fraudulent or unlawful activity.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order. We will communicate any cancellation and refund in accordance with applicable law.
5. CUSTOMER INFORMATION
You are responsible for providing accurate and complete information when placing an order, including your name, billing information, shipping address, email address, and any other information necessary to process and deliver your order.
If incorrect or incomplete information supplied by you affects delivery, additional costs may apply where permitted by law and disclosed in our applicable policies.
You are responsible for keeping your account information secure if you create an account with us.
6. PRICES AND PAYMENT
Prices are displayed in the currency indicated by the store. Depending on the destination and applicable law, prices may include or exclude taxes, customs duties, import taxes, or other charges.
The total amount payable, including applicable shipping charges and any taxes calculated at checkout, will be displayed before you submit your order. Charges imposed by destination-country authorities may be payable separately where applicable and legally permitted.
We make reasonable efforts to ensure that prices are accurate. If an obvious pricing error affects an order, we may contact you before fulfilling it and give you the opportunity to confirm the purchase at the correct price or cancel the order.
Payment must be successfully authorized before an order is processed.
7. SHIPPING AND DELIVERY
Shipping methods, estimated delivery times, and applicable shipping charges are displayed during checkout or described in our Shipping Policy.
Production and delivery times are estimates, not guarantees, unless expressly stated otherwise. Delays may result from production, carriers, customs procedures, weather, or other circumstances outside our reasonable control.
Products fulfilled by third-party manufacturing or fulfillment partners may be shipped from locations different from our business address.
Customers may be responsible for customs duties, import taxes, or other charges imposed by the destination country where applicable and legally permitted.
We are not responsible for delivery problems caused by inaccurate or incomplete information supplied by the customer, to the extent permitted by law. This does not exclude any mandatory obligations we may have concerning delivery.
Additional information is available in our Shipping Policy.
8. THIRD-PARTY FULFILLMENT AND SERVICE PROVIDERS
We may use third-party providers, including Printful, to manufacture, process, package, and deliver products ordered through our store.
These providers may process information necessary to fulfill orders and provide related services, as described in our Privacy Policy.
Our use of third-party service providers does not remove our responsibility to comply with applicable consumer protection obligations. Customers should contact us regarding order problems, defective products, refunds, or replacements.
9. RETURNS, REFUNDS, AND LEGAL RIGHTS
Our Return and Refund Policy explains the procedures and conditions for requesting returns, refunds, replacements, or other remedies.
We may coordinate product-related claims with our manufacturing and fulfillment partners. However, our internal arrangements with these providers do not reduce any rights you may have against us under applicable law.
Nothing in these Terms or our Return and Refund Policy excludes or restricts mandatory rights that cannot legally be excluded or restricted.
Any applicable right of withdrawal, cancellation, repair, replacement, refund, or other consumer remedy remains unaffected.
10. INTELLECTUAL PROPERTY
Unless otherwise stated, content made available through the OverThinking Concept website, including trademarks, logos, names, graphics, photographs, illustrations, product designs, text, videos, and other original materials, is owned by or licensed to the operator of OverThinking Concept.
You may not reproduce, modify, distribute, sell, publish, publicly display, or commercially exploit our intellectual property without prior written permission, except where permitted by applicable law.
The name “OverThinking Concept” and its associated branding form part of the OverThinking brand identity.
11. USER CONTENT AND FEEDBACK
If you voluntarily submit comments, reviews, suggestions, ideas, photographs, or other content to us, you remain responsible for that content.
By submitting content, you confirm that you have the necessary rights to provide it and that it does not unlawfully infringe another person's rights.
Where legally permitted, you grant OverThinking Concept a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the submitted content for operating, promoting, and improving our business and products.
This license is limited to the purposes described above and does not transfer ownership of your content. Any applicable privacy rights remain unaffected.
We reserve the right to remove content that violates applicable law or these Terms.
12. THIRD-PARTY LINKS AND SERVICES
Our website may contain links to third-party websites, applications, or services.
Third-party services are operated independently from OverThinking Concept and may be subject to their own terms and privacy policies.
We are not responsible for third-party content, availability, security, or practices except where applicable law provides otherwise. Nothing in this section excludes liability that cannot legally be excluded.
13. PROHIBITED ACTIVITIES
You must not use our website or services:

To use automated systems in a manner that places unreasonable load on our website or interferes with its operation.
We may take reasonable action to address violations, subject to applicable law.
14. ACCURACY OF INFORMATION
We make reasonable efforts to keep information on our website accurate and current.
Information may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, availability, or other content.
We reserve the right to correct errors and update information when reasonably necessary. Such corrections will not remove rights already granted to customers under applicable law.
15. PRIVACY
Your use of our website and the processing of your personal information are governed by our Privacy Policy.
Personal information may be processed as described in that policy for purposes such as operating the store, processing orders, providing services, meeting legal obligations, and protecting legitimate interests.
Where consent is required for cookies, advertising technologies, or other data processing, we will rely on the applicable consent mechanisms and legal requirements. Using our website does not, by itself, replace consent where consent is legally required.
16. DISCLAIMERS
To the maximum extent permitted by applicable law, the website and its content are provided on an “as available” basis.
We do not guarantee that the website will always be uninterrupted, error-free, secure, or available at all times.
Nothing in these Terms excludes or limits any warranty, guarantee, consumer right, or other protection that cannot legally be excluded or limited.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, OverThinking Concept is not liable for indirect, incidental, special, or consequential losses arising from the use of the website or products.
This limitation applies only to the extent permitted by applicable law and does not exclude or restrict liability that cannot legally be excluded or restricted.
Nothing in these Terms limits liability for intentional misconduct, gross negligence, or any other liability that cannot legally be limited or excluded.
18. FORCE MAJEURE
We are not responsible for delays or failures to perform obligations to the extent they are caused by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, severe weather, war, civil unrest, government action, strikes, transportation disruptions, supply chain disruptions, widespread technical failures, or other events that could not reasonably have been prevented or overcome.
Where reasonably possible, we will take appropriate steps to minimize the effects of such events and communicate material delays to affected customers.
This section does not remove any mandatory consumer rights or obligations that continue to apply.
19. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be applied to the maximum extent permitted by law, and the remaining provisions will remain in effect.
20. NO WAIVER
If we do not immediately enforce a right or provision under these Terms, this does not constitute a waiver of that right or provision.
Any waiver must be made in writing unless otherwise required by applicable law.
21. ENTIRE AGREEMENT
These Terms, together with the policies and information expressly referenced in them, govern your use of our website and purchases from our store, subject to any mandatory rights provided by applicable law.
If there is a conflict between these Terms and a mandatory legal requirement, the mandatory legal requirement will prevail.
22. GOVERNING LAW
These Terms are governed by the laws of Switzerland, without prejudice to mandatory consumer protection laws that apply to a customer in their country of residence.
Nothing in this section prevents a consumer from relying on mandatory legal protections or bringing a claim before a court that has jurisdiction under applicable law.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, products, services, legal requirements, or operational needs.
The updated version will be published on this website with a revised “Last updated” date.
Changes apply from the date they are published unless otherwise required by applicable law. Changes will not retroactively remove rights that customers already have under applicable law.
